1. General terms and conditions – Application and enforceability 

1.1. These General Conditions govern the relations between, on the one hand, the Fondation Boghossian – Fondation privée, having its registered office at Avenue Roosevelt 67, 1050 Brussels, Belgium, registered with the Banque Carrefour des Entreprises under number BE0888.046.579, hereinafter “Boghossian Foundation” and, on the other hand, its Customers who have made a purchase on the Boghossian Foundation e-shop.
1.2. Any purchase made on the Boghossian Foundation e-shop implies unreserved acceptance of the present general terms and conditions in their entirety.
A derogation from these general terms and conditions is possible only with the written consent of the Boghossian Foundation and on a case-by-case basis. In this case, the general terms and conditions will continue to apply to those provisions from which no derogation has been granted.
1.3. The Boghossian Foundation reserves the right to modify these terms and conditions at any time.
1.4. The fact of the Boghossian Foundation not enforcing, at a given time, any of the provisions of these General Terms and Conditions of Sale may not be interpreted as a general waiver of the provisions concerned into the future.

2. Purchase

2.1. The purchase is established by payment for the product purchased on the Boghossian Foundation e-shop. The Boghossian Foundation is bound by the purchase made by the Customer from the date of receipt of payment.
2.2. The Boghossian Foundation will send the Customer an email confirmation of purchase as soon as possible. After confirmation of the purchase, the Boghossian Foundation reserves the right to check whether the Customer actually fulfils the conditions indicated on the e-shop. If not, the purchase will be cancelled. The Boghossian Foundation also reserves the right to refuse the purchase in the following cases:

  • Communication of incomplete or erroneous data;
  • Non-payment of previous deliveries;
  • Purchases involving an abnormally high number of products;
  • Delivery to be made to a geographical area where the risks may be unreasonable, owing either to unreliability of transport or distribution, or to force majeure.

2.3. The Customer is entitled to notify the Boghossian Foundation that he renounces the purchase, without penalty and without giving any reason, within twenty-four (24) hours of said purchase. This period begins upon receipt of the purchase confirmation email.
The Customer who renounces the purchase must give written notification, before the expiration of the twenty-four (24) hour period, via the e-mail address info@boghossianfoundation.be.

3. Price

3.1. The products are sold at the prices in effect at the time of purchase as mentioned on the Boghossian Foundation e-shop.
3.2. The Boghossian Foundation reserves the right to modify at any time the price of products sold as well as the selection of products offered for sale on its e-shop. The new prices will not apply, however, to purchases registered before the price change.
3.3. The price is expressed in euros, with the stated price including VAT.

4. Payment

4.1. Purchases are paid online at the Boghossian Foundation e-shop by credit card. Following receipt of payment, the Boghossian Foundation will issue an invoice which will be sent with the delivery.
4.2. The Boghossian Foundation cannot be held responsible for any malfunctions, interruptions or errors in the payment system.
4.3. The Boghossian Foundation cannot be held responsible for any damage, direct or indirect, caused by the execution of the Customer’s payment.
4.4 The Boghossian Foundation retains ownership of the products sold until full payment of the purchase (delivery costs included).

5. Delivery

5.1. The products purchased are delivered to the delivery address provided by the Customer when purchasing. If the information provided is incorrect, and the Boghossian Foundation has therefore been unable to deliver the product, the Customer will not be entitled to claim any reimbursement. The product may, however, be sent again by the Boghossian Foundation to the customer at the corrected address, subject to the payment of the additional shipping costs and within the limits of available stocks. Any change of billing or delivery address must be notified by the Customer to the Boghossian Foundation via the address info@boghossianfoundation.be.
5.2. Deliveries are made according to availability of stock and in the order of receipt of purchases. The maximum delivery time for the products delivered is thirty (30) days from receipt of payment from the Customer. However, the Boghossian Foundation cannot be held responsible for any delays in the delivery of products.
If, however, one or more purchased product(s) does not reach the Customer at the delivery address provided and within the indicated deadline, it will be the Customer’s responsibility to make contact, within a reasonable time, with the Boghossian Foundation to check the delivery status of the purchase. In this case, it will be possible for the Customer to cancel the purchase, without compensation, subject to giving notification within 30 days following the expiration of the indicated deadline, by email to info@ boghossianfoundation. be. Any sums already paid by the Customer will then be refunded to him within 30 days of receipt of the refund request.
5.3. In the event of force majeure, the Boghossian Foundation will be released from its obligation to deliver.
5.4. Depending on the region and the circumstances, the Boghossian Foundation freely chooses the means and provider of product distribution it deems most suitable.
5.5. The Customer is solely responsible for the receipt of his purchase upon delivery. He is required take all requisite measures to ensure an optimal reception of his purchase.
5.6. The Customer will verify the quality of the products delivered as soon as possible after their delivery.

6. Complaints

6.1. Any complaint relating to an apparent defect must be sent within seven working days of delivery by email to info@boghossianfoundation.be.

6.2. In the event of an apparent or hidden defect, the Boghossian Foundation’s guarantee is limited to the replacement of the product to the extent of available stocks or to the reimbursement of the price of the product paid by the Customer.
6.3. The Boghossian Foundation can in no way be held responsible in the event of force majeure and strike action, or for any technical malfunction which is the responsibility of other companies and/or the Customer.
6.4. The Boghossian Foundation can in no way be held responsible for the consequences of computer viruses, hacker attacks, or other technical attacks on the sales platform by unauthorized third parties. The Boghossian Foundation commits to using commonly used and up-to-date protection mechanisms.
6.5. The Boghossian Foundation can in no way be held responsible for any error occurring in connection with third party systems linked via interfaces with its system (commercial systems, targeting systems, etc.), or for errors occurring as a result of the use of these systems.

7. Protection of private data

The information communicated by the customer is essential to the processing of his purchase. The customer has the right to access and rectify this information by contacting the Boghossian Foundation via the address info@boghossianfoundation.be.

8. Applicable law and competent courts

8.1. Any sale of products or provision of service by the Boghossian Foundation is governed by Belgian law.
8.2. In the event of a dispute, and in the absence of an amicable settlement, the courts of the judicial district of Brussels sitting in the French language will have sole jurisdiction.
